EXCLUSIVE:Karisma-Sunjay Divorce case; Sunjay Kapur to pursue guardianship petition
So it’s final. Both, Karisma and Sunjay have withdrawn their consent from divorce petition. Pinkvilla had exclusively reported three days back that since both the parties were not able to reach a consensus so far, they have decided to withdraw the joint petition for divorce under the Hindu Marriage Act. The court was supposed to decide yesterday (Friday) after they had also spoken to Sunjay over video conferencing/Skype since he is currently in the US. Karisma, who was present in the court had gone through a long counselling session behind closed doors of a judge's chamber, on Tuesday (November 25). Yesterday, the court had an interaction with Sunjay over Skype and granted them permission to withdraw their mutual consent from divorce petition. So what next? Sunjay’s lawyer, Aman Hingorani said, “Karisma is not complying, she is not letting Sunjay meet their children. We are requesting the court to dispose off the matter so that we can pursue our guardianship petition for the custody of the children. She is going back on what she had earlier agreed upon. She is violating across the table the consent terms so we have no option but to pursue our own remedies. Sunjay has complied throughout, Karisma is the one who is backing out.” “Sunjay is currently taking full financial responsibility of her and the children. They are well looked after by him. He is taking care of the maintenance of the flat as well as all their expenses,” added Hingorani. Retorted Karisma's lawyer, Kranti Sathe, “Let them go ahead with whatever they want to, it is Karisma’s call to defend herself. They kept postponing and kept us engaged in talks. They wasted lot of time. Now they will come up with whatever they want to. Documents speak the truth."
According to Karisma, Sunjay did not meet the financial commitments mentioned in the consent terms signed by the couple whereas Sunjay alleged that Karisma did not give him access to their children Samaira and Kiaan. Said Karisma’s lawyer, Kranti Sathe, “It's not true, it's a blatant lie. Karisma always gave him access to both their children. It’s just an excuse, they have failed to meet the commitments. Sunjay refused to comply to the terms and conditions.” The terms and conditions, include, "Sunjay was supposed to set up a trust for the welfare of their two children – Samaira and Kiaan Raj Kapoor, plus he was supposed to give away the Bandra flat to Karisma in her name.”
For those who came in late, Karisma and Sunjay tied the knot in 2003 but their marriage did not work for long. After many fights and patch-ups, Karisma moved out of her husband's house in 2009 and returned to Mumbai. Last December, they decided to end their 12-year long marriage and filed for divorce through mutual consent.
